1. DEFINITIONS & INTERPRETATION
In this Agreement the following terms shall have the following meanings:
“Tentacula” means Tentacula, Schillo & Mayer GbR, Schweppermannstr. 55, 90408 Nürnberg, Germany, DE294756180, and includes all employees and agents of Tentacula;
“User” / “Users” means any third party that accesses the Website and is not employed by Tentacula and acting in the course of their employment; and
“Website” means the website that you are currently using (https://tentaculagames.com) and any sub-domains of this site unless expressly excluded by their own terms and conditions.

3. INTELLECTUAL PROPERTY EXCEPTIONS
Even though we make exceptions to the restrictions in Clause 1, you need to understand that we must safeguard our Intellectual Property rights. Each time you use Tentacula content under the rules of Intellectual Property Exceptions Clause 3.4, 3.5, 3.6, and 3.7, you need to assure yourself and be aware of the following:
3.1 any content used by you contains adequate credits by mentioning all applying copyrights of Tentacula.
3.2 any usage of Tentacula material must be indicated to be unofficial.
3.3 Tentacula assumes no responsibility for the content and legality of any kind of usage of Tentacula material that is used by you as per Clause 3.4, 3.5, 3.6, and 3.7.
Tentacula grants a limited exception to the restrictions in Clause 1 in the following cases:
3.4 None of Tentacula intellectual property may be changed or deformed in any way.
3.5 Companies may use approved artwork, provided by Tentacula for use in product catalogues (in printed or electronic form) and for the purpose of promotion of Tentacula products.
3.6 Artwork, images and other material of Tentacula products may be reproduced by publications for the purpose of reviews and general articles if Tentacula was informed up-front and agreed to the usage.
3.7 Promotional items such as flyers, posters, banners and online advertisements may include Tentacula owned art, logos, photos and images, as long as these materials are promoting Tentacula products for specific tournaments, displays, game shows and other related events and only if Tentacula gave its prior written consent.

Gateway is trademarked by Tentacula.
